RE : ENQUIRY INTO THE IN AND OUT RUNNING OF HORSES UNDER THE CHARGE OF TRAINER FAISAL A. ABBAS ON 28th AND 29th OCTOBER, 2017 :

The Stewards of the Club at their meeting held on 18th February, 2018 interviewed Trainer Faisal A. Abbas, the owner Mr. Kapil Bahl who was accompanied by his Spokesman, Mr. Prem Tharani as also Jockey C. S. Jodha, in the above connection.

The Stewards of the Club having considered all the submissions made and having viewed the video recording of all the races, were not satisfied with the explanation tendered by Trainer Faisal A. Abbas in the below mentioned cases, hence accepted the recommendation of the Stipendiary Stewards and decided as under:-

1.  ENQUIRY INTO THE RUNNING AND RIDING OF AIZEL (AMYN MERCHANT) IN RACE NO.196 – THE SHAMU CHAVAN TROPHY (DIV.I) – RUN ON 29th OCTOBER, 2017:

Considering that AIZEL had veterinary problems, Trainer Faisal A. Abbas should have used the facility of a Mock Race and therefore, the Stewards decided to fine him a sum of Rs.10,000/- for  contravening the Calendar Notification in regard to racing a horse in an unfit condition.

2.  ENQUIRY INTO THE BELOW EXPECTATION PERFORMANCE AND DRIFT IN ODDS ON “CAMOUFLAGED” IN RACE NO.197 – THE CIELO REY PLATE – RUN ON 29th OCTOBER, 2017 :

There was an alarming drift in odds on CAMOUFLAGED were the morning odds were 7/4, he opened at 11/10 and thereafter drifted out to 17/4.

Keeping in mind the alarming drift in odds and the below expectation performance of the horse in Race No.197 as compared to his previous run and with no plausible explanation from Trainer Faisal A. Abbas, the Stewards decided to fine him a sum of Rs.25,000/- for the inconsistent running of the horse.

3.  ENQUIRY INTO THE IMPROVED PERFORMANCE OF “COSA NOSTRA” (BHAWANI SINGH) IN RACE NO.186 – THE GOLFING PLATE RUN ON 28th OCTOBER, 2017 WHICH THE GELDING WON AS COMPARED TO HIS PREVIOUS RUN DURING THE PUNE MEETING 2017 WHERE HE WAS UNPLACED:

For the vast improvement shown by COSA NOSTRA in three weeks time, considering that this was Trainer Faisal A. Abbas’ third offence of a similar nature in the last two years and his second offence during the Pune Meeting 2017, the Stewards decided to fine him a sum of Rs.50,000/-.

Further, the Stewards of the Club integratedly looked into all the enquiries he was subjected to during the Pune Meeting 2017 as well as the current Mumbai Meeting 2017/18 and noted with grave concern that he has been repeatedly questioned by the Stipendiary Stewards with regard to the running and riding of his horses, drift in odds and below expectation performance of his horses, inconsistent running/pattern as well as improved performance of his horses. Further, the Stewards noted that there was a pattern emerging wherein the same Trainer, Owner and Jockey were involved in most of the cases including AIRLIFT, INDIGO and other enquiries conducted during the Pune Meeting 2017 and the current Mumbai Meeting 2017/18.

The Stewards of the Club after hearing his submissions, viewing the concerned races and listening to the Stipes and after having deliberated on the matter at length held the view that this was a matter of grave concern as it brings racing to disrepute.  Therefore, the Stewards of the Club decided to fine Trainer Faisal A. Abbas a further sum of Rs.1,00,000/- and to severely caution him that if he was again found guilty of a similar offence, he will be liable for severe disciplinary action.

The Stewards of the Club were also not satisfied with the explanation tendered by Mr. Kapil Bahl. The Stewards of the Club integratedly looked into all the enquiries his horses were subjected to during the Pune Meeting 2017 as well as the current Mumbai Meeting 2017/18 and noted with grave concern that his Trainers/Jockeys have been repeatedly questioned by the Stipendiary Stewards with regard to the running and riding of his horses, drift in odds and below expectation performance of his horses, inconsistent running/pattern as well as improved performance of his horses.

The Stewards of the Club having deliberated on the matter at length were gravelly concerned with the number of horses under his ownership coming under enquiry and his constant phone calls to Jockey C. S. Jodha on a particular race day, as all this brings racing to disrepute. He was informed that in future if any evidence or circumstantial evidence emerges of any wrong doing on his part on or off the racecourse, the Stewards will be inclined to exercise their right to cancel his ownership and/or take any other action against him under the Rules of Racing of this Club.

Further, the Stewards of the Club integratedly looked into all the enquiries Jockey C. S. Jodha was subjected to during the Pune Meeting 2017 and noted with grave concern that he has been questioned by the Stipendiary Stewards with regard to odds drifting and other race related incidents. Lastly, in the AIRLIFT case, certain observations were made and conveyed to him by the Stewards about his conduct.

The Stewards of the Club therefore, decided to once again severely caution him for the future and put this matter on his record.

RE : ENQUIRY INTO THE RUNNING AND RIDING OF “GLORIOUS EYES” (NEERAJ RAWAL) IN RACE NO.163 – THE SONNY BRAR TROPHY RUN ON 10th FEBRUARY, 2018:

The Stipendiary Stewards reported that they had questioned Trainer Imtiaz A. Sait and Jockey Neeraj Rawal in the above connection. Trainer Imtiaz A. Sait said that since Jockey Neeraj Rawal had ridden this mare last year, he approached him for this ride and he gave it to him instantly. He added that Jockey Neeraj Rawal himself told him that he had ridden a bad race last year and he told Jockey Neeraj Rawal that this mare needs to be settled a bit as she has a good turn of foot and to do his best. He said that Trainer Dallas Todywalla was deputizing for him on this day and he must have given Jockey Neeraj Rawal the same instructions.

Jockey Neeraj Rawal said Trainer Dallas Todywalla told him to sit well up considering that the mare was carrying bottom weight to which he had informed Trainer Dallas Todywalla that he would position himself depending upon how the race is run.

The video recording of Race No.163 was viewed and when asked for his observation, Trainer Imtiaz A. Sait felt that Jockey Neeraj Rawal had ridden a bad race, in that, this was a 2000 metres race and he could have conveniently come out at 2 or 3 stages of the race but he made no attempt to pull the mare out and chose to sit on the inside and followed the wrong horse. Trainer Imtiaz A. Sait felt that it was not mala-fide but Jockey Neeraj Rawal had ridden a bad/incompetent/illjudged race and immediately after the race he had phoned Trainer Dallas Todywalla to say so. Jockey Neeraj Rawal said that his danger, DAFFODILS, was right in front of him. Trainer Imtiaz A. Sait contended that the danger was ODESSA, so how could Jockey Neeraj Rawal assume the danger was DAFFODILS. Pointing to the video replay of the race, Trainer Imtiaz A. Sait said that the mare was keen in the early part and was throwing her head up and Jockey Neeraj Rawal should have given her the head and not held her up and once she relaxed then settle her and tuck her in.

Jockey Neeraj Rawal said that he thought that by following the front horse he would get his run but as all the horses travelled at the same pace, he was unable to get a clear run. Further, if he had to come out, he would have had to check the mare and bring her out. To a specific question, he said that the mare was moving well in the straight, however, she did not show the zest to take the slight gap.

To a specific question, Trainer Imtiaz A. Sait the mare has no problems and travels well both from the inside and outside.

The video recording of the previous race i.e. Race No.100 was viewed. Trainer Imtiaz A. Sait said that he had lost the 3rd place. He said that he does not doubt the integrity of the Jockey but he had ridden a bad race and must be accountable for that, especially since he had asked for the ride.

Having heard the submissions made by the Trainer and Jockey and having viewed the video recording of the race in question as also the mare’s previous run, the Stipendiary Stewards were of the opinion that although the mare did not have a clear passage in the final stages of the race, however, Trainer Imtiaz A. Sait felt that it was not mala-fide but Jockey Neeraj Rawal had ridden a bad/incompetent/illjudged race, as such, the matter was placed before the Stewards for such action as deemed fit.

The Stewards of the Club at their meeting held on 23rd February, 2018 interviewed Trainer Trainers Imtiaz A. Sait and Dallas Todywalla who had deputized for Trainer Imtiaz A. Sait on 10/02/2018, as also Jockey Neeraj Rawal in the above connection and having heard them and having viewed the video recording of the race, decided that no action was called for in the matter.
