ADDITIONAL REPORT/S :

RE : ENQUIRY INTO THE RUNNING AND RIDING OF “GOOD THING” (DASHRATH SINGH) IN RACE NO.66 – THE STAR WISH PLATE (DIV.I) - RUN ON 26TH AUGUST, 2017 :

The Stipendiary Stewards reported that they had questioned Trainer Adhirajsingh Jodha and Jockey Dashrath Singh in the above connection. Trainer Adhirajsingh Jodha said that in the previous start the filly had gone to the front and fizzled out, therefore, he had instructed theJockey to tuck her in/take cover this time considering that she was drawn on the outside and to do his best in the straight.

The video recording of the race was viewed and when asked for his observation, Trainer Adhirajsingh Jodha said that the Jockey sat a bit far back and after the race the Jockey had informed him that he was not able to take cover and hence he rode her in check and thereafter switched her in and the filly settled well. He added that Jockey Neeraj Rawal who rode the filly in the previous start had advised him to take cover and to run her in a 1200 metres race but he wanted to run the filly over longer trips and therefore he had raced her in this 1400 metres race. To a specific question, Tr.Adhirajsingh Jodha said that he would run the filly in a similar manner in the future i.e. to give her cover.

Jockey Dashrath Singh confirmed the instructions.

The video recording of the race was viewed again and when questioned about his riding effort in the straight, Jockey Dashrath Singh said that when he made his move, the horses in front were shifting in and out, hence he was unable to take the gap.

Having heard the submissions made and having viewed the video recording of the race in question as also its previous starts, the explanation tendered by the Trainer and Jockey was noted for future reference.

RE : ENQUIRY INTO THE RUNNING AND RIDING OF “POWERHAUS” (DASHRATH SINGH) IN RACE NO.62 – THE STAR WISH PLATE (DIV.II) RUN ON 26TH AUGUST, 2017 :

The Stipendiary Stewards reported that they had questioned Trainer Narendra Lagad and Jockey Dashrath Singh in the above connection. Trainer Narendra Lagad said that he had instructed the Jockey to take a good jump and sit in 1st/2nd position, i.e. if the filly goes to the front, let her go, not to check her, however, if someone was chasing and going, then to settle her in 2nd position. Jockey Dashrath Singh confirmed the instructions and added that the filly went to the front comfortably hence he did not want to break her stride. He said that the filly was lugging in.

On being pointed out, Trainer Narendra Lagad confirmed that in her previous run over 1400 metres i.e. Race No.197 run during the Mumbai Meeting 2016/17, the filly was settled behind. He said that he intends to race the filly next over 1200 metres as he felt that she did not take the trip well this time out. He said that he would not blame the Jockey as he had got the filly on the bridle quite well and when he asked for an effort, the filly responded but did not last out.

The video recording of the incident of fall of whip was viewed and when asked for his opinion, Trainer Narendra Lagad said that  when the whip fell, the other horse had already passed the filly and it would not have made a difference at that stage. He added that his two runners KNIGHT’S QUEST and POWERHAUS were supposed to go in different division as they have a different set of owners except Mr.Vijay Shah who has a share in both the horses but they ended up in the same division and the owners of both the horses wanted good riders because on handicap, both had an equal chance, hence he engaged good riders on both the horses. When questioned about the work pattern, Trainer Narendra Lagad said that POWERHAUS was a light frame filly, hence he gave her light work.

On a request from Trainer Narendra Lagad, the video recording of Race No.31 was viewed and the trainer explained that he felt that the filly was not comfortable passing the other horses, hence he had decided to send her to the front in the race in question, however, the additional 200 metres may have not suited her. He said that he had entered the filly on Sunday, 3rd September, 2017 over 1200 metres and may be he would ask the Jockey to settle her and then ride her out.

When questioned, Jockey Dashrath Singh said that he rode as per his instructions and sat  comfortably till the 400 metres and thereafter when he rode her out the filly responded initially and then gave up. When questioned about the loss of his whip, he said that the whip had come in contact with the rails and fell and that the loss of whip would not have made a difference to the result of the race.

After hearing the submissions made and having viewed the video recording of the race in question as also the incident of the loss of whip and the filly’s previous run in Race No.31 and having scrutinized the Work Log Books and the betting sheets, the explanation tendered by the Trainer and Jockey was noted and Jockey Dashrath Singh was warned in regard to his whip fall.

The Stewards of the Club at their meeting held on 23rd September, 2017 considered the above report and having viewed the video recording of the race as also the incident of whip fall, decided that no further action was called for in the matter.

RE : ENQUIRY INTO THE RUNNING AND RIDING OF “STREETJAMMER” (J.CHINOY) IN RACE NO.69 – THE JAIDEV PLATE - RUN ON 26TH AUGUST, 2017

The Stipendiary Stewards reported that they had questioned Trainer Dallas Todywalla and Jockey J.Chinoy in the above connection. Trainer Dallas Todywall said that he had lost a certain race as Jockey S.A.Amit (THE CIVILIAN) kept tightening his hose and his Jockey was unable to use the whip. He attributed it to the Pune Track as he felt that the outside horses travel better.

The video recording of the race was viewed and when asked for his observation, Trainer Dallas Todywalla said that he had instructed the Jockey to be up there, then come on the outside and to do his best. He said that the horse missed the kick at the start and there was a lot of kick back and in the straight his Jockey did not have enough room to use the whip. He felt that the distance of 1200 was too sharp for the horse and his optimum trip would be 1400 metres. He reiterated that if not for the interference in the last furlong, his horse would have won the race.

The video recording of the back view was viewed and Trainer Dallas Todywalla agreed that the tightening/interference does not look as bad.

Jockey J.Chinoy stated that he wanted to sit well up, however, since the horse does not have initial speed and he was running over 1200 metres for the first time, having discussed the matter, they felt that it would be best to sit close 3rd/4th and to do the best. He said that all the way THE CIVILIAN (S.A.Amit) kept tightening him and passing 300 metres he was forced to pull his horse out and in doing so he carried THE CIVILIAN outwards for which he was fined Rs.3,000/-. Thereafter, throughout the straight, THE CIVILIAN was in close proximity due to which he did not have sufficient room to pull out the whip and hence he rode out hands and heels until he had sufficient room to use the whip.

Having heard the submissions made by the Trainer and Jockey and having viewed the video recording of the race, the Stipendiary Stewards were of the opinion that although Jockey J.Chinoy had made some efforts on his mount, however, as he did not change his whip hand which may have helped, he has been warned and asked to be more judicious in the future.

RE : ENQUIRY INTO THE RUNNING AND RIDING OF “TAKE FIVE” (YASH NARREDU) IN RACE NO.78 – THE SU CHALIYO PLATE RUN ON 27TH AUGUST, 2017 :

The Stipendiary Stewards reported that they had questioned Trainer M.Narredu and Jockey Yash Narredu in the above connection. Trainer M.Narredu said that he had instructed the Jockey  to try and go to the front or else to sit in a good position and to do his best. Jockey Yash Narredu confirmed the instructions and added that after jump out ALSACE (Amyn Merchant, dr.9) came in sharply and tightened him, hence he dropped back. To a specific question, he said that there was a one horse gap on the inside hence he came from the inside and thereafter he had horses on the outside. He said that he kept pushing the filly all the way and had done his best.

Trainer M.Narredu said that the filly moved faster on the better track. He said that he was planning to run her over 1600 metres but ran her in this 1200 metres on the advice of his senior Jockey, Mr.Jethu Singh, however, he now feels that this distance was sharp and he will run her next over a longer trip.

Having heard the submissions made and having viewed the video recording of the race, the explanation tendered by the Trainer and Jockey was noted.

The Stewards of the Club at their meeting held on 23rd September, 2017 considered the above report. They interviewed Trainer M.Narredu and Jockey Yash Narredu and having heard them  and having viewed the video recording of the race, decided to give Jockey Yash Narredu the benefit of the doubt.

RE : ENQUIRY INTO THE BELOW EXPECTATION PERFORMANCE OF “OSLO COURT” (BHAWANI SINGH) IN RACE NO.102 – THE PUNE CANTONMENT BOARD TROPHY (DIV.II) - RUN ON 9TH SEPTEMBER, 2017 :

The Stipendiary Stewards reported that they had questioned Trainer Altamaash A.Ahmed and Jockey Bhawani Singh in the above connection. Tr.Altamaash A.Ahmed stated that OSLO COURT was an unsound horse and in his first start at Mumbai the horse trailed the field in the early part and then improved slightly to finish 6th. After that race, Jockey Neeraj Rawal told him that the horse was green and immature and advised him to take the horse to Bangalore and he was entered to race there but played up at the gates and was withdrawn. He said that in the race in question, he had instructed Jockey Bhawani Singh to take a jump and settle the horse and thereafter to do his best in the straight. On being asked about his observation, he said that the horse took a smart jump and initially fought for his head but thereafter settled down and coming into the straight the horse did not respond and faded out. He added that immediately after the race the horse was scoped and no abnormality was found, however, he was planning to do a dynamic endoscope on the horse subject to availability of Dr.Mirza. To another question, Trainer Altamaash A.Ahmed said that the horse had worked well and therefore he may been tipped in this race.

Jockey Bhawani Singh confirmed the instructions and stated that in his effort to settle his mount, the horse resisted and threw its head up a couple of times and thereafter settled down and coming into the straight the horse did not respond despite his urgings.

Having heard the submissions made and having viewed the video recording of the race, the explanation tendered by the Trainer and Jockey was noted.

RE : ENQUIRY INTO THE RUNNING AND RIDING OF “BAY OF LOVE” (N.NADEEM) IN RACE NO.103 – THE PUNE CANTONMENT BOARD TROPHY (DIV.I) - RUN ON 9TH SEPTEMBER, 2017 :

The Stipendiary Stewards reported that they had questioned Trainer H.J.Antia and Jockey N.Nadeem in the above connection. Trainer H.J.Antia said that he had instructed the Jockey to take a good position and to do his best. The video recording of the race was viewed and when asked for his observation, Trainer H.J.Antia said that the horse missed the kick  and the Jockey tried to get into a good position but took a little time to do so. He said that the horse clocked the same time in this race as he did in the previous start. He felt that having missed the kick, the Jockey should have tried to settle the horse, however, this boy has the habit of continuing to ride if he was not in position until he gets the desired position and he has been talking to him to correct this habit. To a specific question, Trainer H.J.Antia felt that the Jockey had got tired and was a bit weak in his riding effort in the straight.

Jockey N.Nadeem confirmed the instructions. The video recording of the race was viewed and it was pointed out to Jockey N.Nadeem that he rode in patches, particularly in the straight and and was weak in his riding effort. Jockey N.Nadeem said that he was not tired in the straight but he was a little late in pushing.

To a question regarding the future plans for this horse, Trainer H.J.Antia said that he intends to race this horse every two weeks.

Having heard the submissions made and having viewed the video recording of the race, the enquiry has been kept open and a close watch would be kept on the future running of the horse.

RE : ENQUIRY INTO THE RUNNING AND RIDING OF “DOUBLE NINE” (P.S.CHOUHAN) IN RACE NO.112 – THE PLEASURES PLATE - RUN ON 10TH SEPTEMBER, 2017 :

The Stipendiary Stewards reported that they had questioned Trainer Nosher Cama and P.S.Chouhan in the above connection. The video recording of the race was viewed and Trainer Nosher Cama stated that one needs to watch Jockey N.Nadeem (BEE QUIRKY) who he felt kept marshalling his horse through the race and at one point shifted in on to his horse which was unusual.

Jockey P.S.Chouhan said that he was instructed to sit in 4th or 5th position and to do his best. He said that he had done his best but the horse was tired towards the end.

Tranier Nosher Cama said that DOUBLE NINE was basically a 1000 metres horse and hence he had told Jockey P.S.Chouhan to save the horse. When asked whether his horse could have got the 3rd place, Trainer Nosher Cama felt that DIVINE MAGIC who finished third, was a better horse and his horse was stopping in the last part.

Having heard the submissions made and having viewed the video recording of the race, the explanation tendered by the Trainer and Jockey was noted and Jockey P.S.Chouhan was asked to ride out vigorously till the end.

RE : ENQUIRY INTO CERTAIN QUESTIONABLE INFORMATION FOUND IN JOCKEY AKASH AGARWAL’S MOBILE PHONE DURING THE COURSE OF ENQUIRY INTO THE RUNNING AND RIDING OF “EL TYCOON” IN RACE NO.219 RUN ON 12TH MARCH, 2017 AND ENQUIRY INTO THE RUNNING AND RIDING OF “FASHIONABLE GAIT” IN RACE NO.294 RUN ON 16TH APRIL, 2017 :

The Stewards of the Club at their meetings held on 13th August, 2017 and thereafter on 22nd September, 2017 interviewed Mr.Akash Agarwal and his Spokesman, Mr.Sughosh Nagendra, in reference to the captioned subject matter.

The Stewards of the Club, after considering the evidence on record before them as also Mr.Akash Agarwal’s oral and written submissions dated 13th August, 2017 and 9th September, 2017, and after hearing him/his Spokesman, Mr.Sughosh Nagendra, as also the Stipendiary Stewards, and after giving Mr.Akash Agarwal the opportunity to cross examine the Stipendiary Stewards and also to bring in his witnesses, which he did, arrived at the following decision. It was significant that Mr.Akash Agarwal had not denied the veracity or authenticity of his mobile phone chats and conversations, which substantiate, beyond any doubt, the core allegation against him of having habitually indulged in betting, and having interest in, and facilitating betting, which is a serious breach of the Rules of Racing and the terms and conditions of his licence. The Stewards found no evidence of wrong doing or excess of powers on part of the Stipendiary Stewards in their seeking to examine his mobile phone records (which, in any event, he had undertaken in writing to so submit), as such action was critical for protecting the integrity of racing, which the Stewards are duty bound to protect. Having heard all concerned and having deliberated the matter at length, the Stewards of the Club rejected his defenses. The Stewards concluded that under the Rules of Racing and the terms and conditions of his licence, Mr.Akash Agarwal had:-

a)       misconducted himself;

b)       He had indulged in betting, and had interest (both direct and indirect) in wagers and bets, and/or he had also facilitated bets on races.

In light of the above serious breaches and misdemeanours, and Mr.Akash Agarwal’s past track record {including a 2 years suspension for not allowing his mount to run on merits (subsequently reduced) }, the Stewards of the Club, in the exercise of their discretion, rejected his application for grant of a Jockey’s licence for the Season 2017/18 which was pending before them. In addition, the Stewards have strongly recommended that his application for a license, if made by him for the Seasons of 2018/19 and 2019/20, also be rejected.
