ADDITIONAL REPORTS :

RE : ENQUIRY INTO THE WITHDRAWAL OF “CABELLERO” FROM RACE NO.175 –THE FLAREON PLATE (DIV.I) RUN ON 7TH MARCH, 2019 ON VETERINARY GROUNDS – TRAINER MANSOOR SHAH

An enquiry was initiated by the Stipendiary Stewards in the above matter and having heard the submissions made by Trainer Mansoor Shah, Trainer Sangramsinh N.Joshi was also Trainer Mansoor Shah’s staff, it was noted that :

1)            CABELLERO was an On Money favourite at 85/100 – 90/100  in Race No.175;

2)            The horse was trotting lame in the paddock. He was examined by the Club’s V.O. before the race in the Saddling area and was found to be trotting sore by the right fore leg and was certified unfit to race, hence he was withdrawn on veterinary grounds;

3)            At the request of Trainer Mansoor Shah the horse was again examined by the Club’s Vets the next day at the stables and their report states “The colt was trotted at the stable on soft ground without flexion and found to be trotting sound. After flexion of the right fore fetlock joint the colt was observed to have pain on flexion (Grade +1) after flexion the colt was trotted and observed to be trotting lame by right fore leg for few initial steps and afterwards the colt was trotting sound.

4)            After questioning Trainer Mansoor Shah and Trainer Sangramsinh N.Joshi and going through the Medical and Work Log Books, it was found that the horse has a problem as it has had long periods of rest;

5)            The work pattern prior to both the races is different i.e. prior to Race No.53 on 16th December, 2018 the horse had five 7 furlong canters whereas before Race No.175 he has gone through the gate only twice and was on rest a day prior to the race;

6)            The video recording show that :

                a)  The Race day morning camera where the horse is sound;

                b)  When the Vets checked the horse the next day at the stables on Trainer’s

                    request, the  video shows that the horse was trotting lame after flexion

Keeping the above circumstances in mind, the Stipendiary Stewards felt that bringing an On Money favourite into the paddock lame, was gross negligence on the part of Trainer Mansoor Shah, as such, the matter was reported to the Stewards for such action as deemed fit.

The Stewards of the Club at their meeting held on Saturday, 13th April, 2019 interviewed Trainer Mansoor Shah as also the Sr.V.O., Equine Hospital, in the above connection and having considered all papers and proceedings before them and having heard the submissions made, the Stewards noted that there was variation in the work pattern of this horse prior to Race No.175 as compared to his earlier runs. The Stewards were not satisfied with the explanation tendered by Trainer Mansoor Shah and held him guilty of bringing an “On Money” favourite into the paddock, lame, which amounted to gross negligence on his part as a licensed trainer towards his horses, Owners and the Club. The Stewards noted that Trainer Mansoor Shah has been a granted a provisional license with certain pre-conditions, however, they refrained from invoking the said conditions imposed on him and instead decided to fine him a sum of Rs.50,000/-. Further, in view of his past record wherein he has been consistently punished for various racing offences, he was warned to treat this as a final warning and a strict watch would be kept on the running of his horses as well as management of his stable.

RE : ENQUIRY INTO THE RUNNING AND RIDING OF “STRONG STORM” IN RACE NO.157 – THE NOBLE OPINION PLATE RUN ON 21ST FEBRUARY, 2019 :

Vide this office letter dated 25th February, 2019 Trainer Dallas Todywalla and Jockey P.Trevor were requested to submit in writing their instructions and observation of the race.

Vide his e-mail dated 27th February, 2019 Jockey P.Trevor stated that the instructions were given to him by the Owner and Trainer i.e. to cover up immediately after the jump without pushing the filly. However, if he finds himself in the front and the filly was too keen and fighting for her head, then don’t hold her back. He said that there were no specific instructions on the positioning of the filly.

Jockey P.Trevor stated that as was evident on the video recording, he was bumped at the start but still managed to get a good position and coming into the straight there was a wall of horses in front of him whereby he had to pull the filly out but in the last 150 metres, under pressure his filly started to lean inwards despite which he did his best.

Trainer Dallas Todywalla stated that in her previous start, the filly went to the front and got beat, as such, this time he told the Jockey to sit in 2nd/3rd position and the owner was present at the time of instructions and said “do your best”.

The video recording of Race No.157 was viewed and Trainer Dallas Todywalla pointed out that he felt that Jockey P.Trevor should have been sitting where SULLIVAN was or may be 3rd and passing the 1000 metres  he should have moved between the two horses i.e. HUZZAH’S GRACE and REGAL SHOT but instead he dropped back and lost total position. He further pointed out that ABERLOUR, the eventual winner had moved up and covered him at about the 600 metres. He also pointed out that passing the 200 metres the filly had responded to the whip and instead of persisting with the whip, Jockey P.Trevor puts it away and then picked it up again when the race was almost over.

Having considered the submissions made and having viewed the video recording of the race, the Stipendiary Stewards are not satisfied with the explanation tendered by Jockey P.Trevor and have decided to suspend his Jockey’s license for 2 Race Days for riding an incompetent race i.e. if he applies for a Jockey’s license for the Season 2019/20, the same will be granted to him, however, his license shall stand suspended for 2 Race Days starting from the first race day of the Pune Meeting 2019 (permitted to ride work/mock race).

The Stewards of the Club at their meeting held on Saturday, 13th April, 2019 considered appeal from Jockey P.Trevor in the above connection.

The Stewards of the Club considered all papers and proceedings before them and having heard Jockey P.Trevor and Trainer Dallas Todywalla, having viewed the video recording of Race No.157 and having deliberated the matter, decided to reject the appeal.
