ADDITIONAL REPORTS :

RE: ENQUIRY INTO THE RUNNING AND RIDING OF “MADAGASCAR” (S.ZERVAN) IN RACE NO.21 – THE SNOW DEW PLATE, RUN ON 29TH NOVEMBER, 2018 :

Immediately after the race, the Stipendiary Stewards had questioned Trainer P.Shroff and Jockey S.Zervan regarding the running and riding of MADAGASCAR in Race No.21. The same evening the Stewards of the Club interviewed both the Trainer and Jockey and recorded their preliminary statements.

Subsequently, Trainer P. Shroff and Jockey S. Zervan were questioned by the Stipendiary Stewards on 2nd December, 2018.  Jockey S. Zervan said that he had worked the horse on 25th November, 2018 and the horse had worked extremely well after which he had requested the owners for this ride and they had obliged. Subsequently, after having cantered the horse a day prior to the race and not being satisfied with the action of the horse, he had immediately reported the same to the trainer, who immediately checked the horse in his presence and the horse trotted sound. Thereafter, at race time, he cantered the horse on the way to the starting gates and he found no abnormality at that point, however, after jump out, the horse was hesitant and he felt that the horse was lame by both fore legs for the first 4/5 furlongs. To a question, Jockey S.Zervan stated that since the horse was a joint favourite, he did not stop riding and pull up the horse keeping in mind the earlier pattern where the horse had trotted sound after his canter and also considering that he had trotted sound on the way to the start and he felt that if he again trotted sound after the race, then he may be held liable.

At this point Tr. P.Shroff informed that the same evening of the race, the Club’s V.O. having x-rayed both fore knee and fetlock joints had reported that no abnormality was detected. Further, on 30th November, 2018, he once again sent the horse to the Club’s Equine Hospital and x-rays were taken of both fore humerus and again no abnormality was detected.

The video recording of Race No.21 as also Race No.182 run during the Mumbai Meeting 2017/18 was viewed and Jockey S. Zervan pointed out the difference in the galloping style of the horse in both the races and also emphasized on the scratchy action in the race in question. Trainer P. Shroff reiterated that he had the horse examined on two occasions after this race and no abnormalities were detected.

Having heard the submissions made and having viewed the video recording of the race in question as also the horse’s previous run i.e. Race No.182 run during the Mumbai Meeting 2017/18, the Stipendiary Stewards were of the view that Jockey S. Zervan, in compliance with the Rules of Racing should have accordingly informed the Stewards before the race any condition which he felt may affect the running of the horse in the race since he was aware that he was riding a horse that was in the money, as such, the matter was reported to the Stewards for such action as they deem fit.

The Stewards of the Club at their meeting held on Thursday, 13th December, 2018 interviewed Trainer P. Shroff and Jockey S. Zervan in the above connection and having heard them and having viewed the video recording of the race,

the Stewards were not satisfied with the explanation tendered by Jockey S. Zervan. The Stewards noted that :-

a)            By his own admission he cantered the horse on the way to the start and found nothing amiss with him and in the same breath he stated that soon after the start he felt there was something amiss with the horse and therefore did not urge his mount and sat a detached last. Thereafter, coming around the bend he urged the horse slightly and the horse has responded to the urgings and covered considerable ground. Also, to a specific question, he stated that he found the horse sound and therefore he urged him around the bend.

All his above statements were contradictory in nature.

b)            The Stewards noted that MADAGASCAR was examined by the Club’s Vet immediately after the race and was found to be sound in the trot and the X-Ray Report the following day did not reveal any abnormality.

c)             The part owner of the horse expressed his dissatisfaction with his riding.

d)            If he had strong doubts before the race about the soundness of the horse which may affect his running in the race, then under Rule 167 (b) he was duty bound to bring the same to the notice of the Stewards prior to the race, which he failed to do.

However, considering that there was no drift in the odds and his admission in front of the Stewards that he had made an error of judgement, the Stewards decided to not charge him for “unsatisfactory riding” and held him guilty of riding an ill-judged race thus contravening Rule-159(b) of the Rules of Racing.

Therefore, the Stewards decided to suspend his Jockey’s license for 4 Race Days i.e. from 30th December, 2018 to 10th January, 2019 (both days inclusive) and to fine him a sum of Rs.50,000/- for riding an ill-judged race (permitted to ride work/mock race).
