Chouhan was also given the opportunity to cross examine Mrs. Bakhtawar B. Chenoy (part-owner), which he declined. He was also given the opportunity to elaborate on each and every point of his grounds of appeal.

The Board of Appeal deliberated the matter and applied their minds to the entire facts and circumstances. Whilst the Board concurred with the findings of the Stewards of the Club,  keeping in mind that this was Jockey P. S. Chouhan’s first offence of this nature, the Board of Appeal unanimously decided to modify his punishment as under :-

a)       To modify the punishment imposed on him by the Stewards of the Club to the effect that his Jockey’s license will now stand suspended w.e.f. 28th April, 2018 till the end of the Mumbai Meeting 2017/18. RE : ENQUIRY INTO THE RUNNING AND RIDING OF “SCION” IN RACE NO.271 – THE AHU PLATE (DIV.II) RUN ON 7TH APRIL, 2018 :

The Stipendiary Stewards reported that they had questioned Trainer Altaf Hussain and Jockey Vishal N. Bunde in the above connection. Trainer Altaf Hussain stated that he had instructed the Jockey to jump, sit in 3rd/4th position and to do his best in the straight. Jockey Vishal N. Bunde confirmed the instructions. The video recording of the race was viewed and Jockey Vishal N. Bunde was asked as to why he dropped back approaching 600 metres to which he stated that he was racing on the haunches of OLIVIA KASPEN who shifted out while negotiating the bend and in an effort to save his mount, he had to check. It was pointed out to Jockey Vishal N. Bunde that he could have held his position instead of dropping back, to which he replied that the pace had quickened at that moment and it appears as though he had dropped back.

Whilst Trainer Altaf Hussain concurred with the opinion of the Stipendiary Stewards that Jockey Vishal N. Bunde could have held his position, however, taking into account the Jockey’s riding caliber and his relative inexperience, the Stipendiary Stewards decided that no action was called for and the enquiry was closed.
