ADDITIONAL REPORT/S:

RE: ENQUIRY IN RESPECT OF TRAINER DALLAS TODYWALLA 1) FAILING TO REPORT THAT HIS CHARGE “MUFASA” LEFT HIS CHARGE ON 26/02/2015; 2) CLAIMING FEED AND UPKEEP CHARGES FROM THE OWNERS FOR FOUR MONTHS; AND 3) GIVING MISINFORMATION TO THE CLUB ABOUT THE NUMBER OF HORSES IN HIS CHARGE FOR PUNE MEETING 2015 :

The Stewards of the Club at their meeting held on Saturday, 15th August, 2015 considered note dated 6th August, 2015 from the Stipendiary Stewards in reference to the above incident. They interviewed Trainer Dallas Todywalla and having heard him, were not satisfied with the explanation tendered by him. However, keeping in mind that he had admitted his mistake and apologized for the same, the Stewards took a lenient view and decided to fine him a sum of Rs.5,000/- and to warn him for the future.

RE : ENQUIRY INTO THE IMPROVED PERFORMANCE OF “ESSENCE OF LOVE” IN RACE NO.353 – THE VICTORY MARCH PLATE RUN ON 25TH APRIL, 2015 :

The Stipendiary Stewards reported that they had questioned Tr.H.J.Antia in the above connection. It was pointed out to Trainer H.J.Antia that “ESSENCE OF LOVE” ran within a span of two weeks and showed drastic improvement compared to his previous run in Race No.314 where he had placed fifth.

Trainer Antia stated that in Race No.314 the gelding sat right up with the pace and coming into the home stretch,  he had nothing left, However in Race No. 353 he sat relatively off the pace and despite a big field, turning for home, found himself on the outside which gave him a clear run. Also the shorter distance of the race in question helped its cause.

After hearing all the submissions made and viewing the video of the gelding’s previous as well as the current race and  keeping in mind the change of Jockey and the drastic change in odds between the two races (from 25/1 in Race No. 314 to 7 ½ in Race No. 353), Tr.H.J.Antia was fined a sum of Rs. 10,000/- and cautioned for the future.

RE : ENQUIRY INTO THE POOR PERFORMANCE OF “EGYPTIANA” IN RACE NO.16 – THE P.HADOW TROPHY RUN ON 24TH JULY, 2015 – TRAINER HOSIDAR DAJI AND JOCKEY P.KAMLESH :

Trainer Hosidar Daji and Jockey P.Kamlesh were questioned in the above connection. The Jockey said that he was instructed to go to the front or sit 2nd/ 3rd. He said that the filly travelled well initially but simply gave up in the straight hence he felt it was pointless to keep urging her. He added that the filly was changing legs in the straight after passing the one furlong. However, on viewing the replay of the race it was established that the filly had not changed her legs as stated by the Jockey and the filly did not give up at any stage of the race but the Jockey had stopped riding for no apparent reason.

The Trainer said that the filly was scoped 24 hours later but came clean, however he was satisfied with the ride and blamed the filly’s poor performance on her dislike for the going. He added that the filly has never won in her first start of the season and he may have misjudged her fitness.

After hearing the submission made and watching the replay of the race, the Stipendiary Stewards were not satisfied with the explanation tendered by the Trainer and Jockey and decided :-

1.       To fine Trainer Hosidar Daji a sum of Rs. 10,000/- for unsatisfactory running of his charge, wherein by his own admission, he had stated that he may have misjudged the filly’s fitness and was also satisfied with the Jockey’s riding in the straight.

2.       To suspend Jockey P. Kamlesh w.e.f. 22nd August, 2015 to 23rd August 2015 (both days inclusive) for failing to persevere with his mount in the straight (permitted to ride work)..

The Stewards of the Club at their meeting held on Saturday, 15th August, 2015 considered appeals from Trainer Hosidar Daji and Jockey P.Kamlesh in the above connection and having heard them and viewing the video of the race, decided to partially allow the appeals and :-

a)       reduced the fine imposed on Trainer Hosidar Daji to Rs.5,000/-;

b)       reduced the period of suspension of Jockey P.Kamlesh to one race day, his license was suspended for 30th August, 2015.

RE : ENQUIRY INTO THE RUNNING AND RIDING OF “BIG BANG” IN RACE NO.18 – THE ORIENTAL EXPRESS PLATE RUN ON 24TH JULY, 2015 :

The Stipendiary Stewards reported that they had questioned Tr.Narendra Lagad and Jockey J.E.Pereira in the above connection. Trainer Narendra Lagad said that he had instructed the Jockey to sit in 6th or 7th position and to ride out in the straight. He added that the gelding shifted out immediately after the start wherein the Jockey had to steady him and also that he hung out in the straight. He said that considering the gelding’s past performance, he was satisfied with the Jockey’s handling of his mount. He added that according to him, this was the gelding’s best performance.

The Jockey confirmed that BIG BANG hung out in the straight. However, when asked as to why he failed to report the same to the Stipes immediately after the race, he had no reply.

After hearing the submission made by the Trainer and Jockey and watching the replay of the race, the Stipendiary Stewards decided to keep a close watch on the future running of the gelding.

RE : ENQUIRY INTO THE RUNNING AND RIDING OF “ALECTAR” IN RACE NO.24 – THE CARBON STAR PLATE (DIV.I) RUN ON 1ST AUGUST, 2015 :

The Stipendiary Stewards reported that they had questioned Tr.Altaf Hussain and Jockey R.Shelar in the above connection.  Trainer Altaf Hussain said that he had instructed the Jockey to ride his own race. On Further enquiry, it was observed that the Jockey does not work the horse and as a result would not know the habits of the horse. When asked as to why such instructions were given to a jockey who had not worked the horse, Tr.Altaf Hussain had no reasonable answer except to say that he gives rides to all the boys who work for him.

Jockey R.Shelar, when asked why he chose to travel wide all along and shift-in in the straight, he replied that there was kick back particularly at the bend, therefore he chose to stay clear of the same.

After hearing the submissions made and viewing the video of the race, the Stipendiary Stewards were of the opinion that ALECTAR could have run a better race. Not being satisfied with the explanation tendered by the Trainer and the Jockey, both were fined a sum of Rs. 5,000/- each.

RE : ENQUIRY INTO THE RUNNING AND RIDING OF “CARMA” IN RACE NO.28 – THE THANDA PLATE  RUN ON 2ND AUGUST, 2015 :

The Stipendiary Stewards reported that they had questioned Tr.Imtiaz A.Sait and Apprentice R.Aj Ajinkya in the above connection. The Trainer stated that in the filly’s first outing in Race No.211 in Mumbai on 22nd Feb 2015 over 1200 metres, she had placed 5th and Jockey A.Sandesh who rode her, reported that she ran green. Subsequently the filly raced on 29th March, 2015 in Race No. 294 over 1600 metres where she finished 4th with Jockey Neeraj Rawal, which was her best race. He added that the filly is sound and she had gained 34 kgs since she was brought to Pune. He said that the filly performs better when she runs along the rails from the front and since she received a check passing 1800m she could not go to the front in the race in question. Also he had used Blinkers on her for the first time. It was pointed out to the trainer that going through his Work Log Book, it was noticed that pace work outs were given to the filly by Jockey Hamir Singh and not App.R.Ajinkya, to which he replied that Jockey Hamir Singh works most of his horses and that he decided to put up Apprentice R.Ajinkya only after the Handicap stage, however he ensured that the Apprentice worked the filly prior to the race and that the Apprentice was satisfied with the work. He said that the filly will soon be going to Trainer Dallas Todywalla.

After hearing the submissions made Trainer Imtiaz A.Sait and Apprentice R.Ajinkya, the Stipendiary Stewards decided to keep a close check on the future performance of the filly.

RE : ENQUIRY INTO THE RUNNING AND RIDING OF “GERONIMO” IN RACE NO.33 – THE CACOPHONY PLATE RUN ON 2ND AUGUST, 2015 :

The Stipendiary Stewards reported that they had questioned Tr.S.K.Sunderji and Jockey S.Zervan in the above connection. Trainer S. K. Sunderji said that his instructions to the Jockey were to take a jump and sit in the mid field, improve gradually and to do his best in the straight.

The video of the race was viewed and the trainer was to explain the reason for the poor performance. Trainer S.K.Sunderji said that the horse has a bad temperament and even during morning track work he has noticed that on one day the horse pulls and on another, he doesn’t. Also, he felt that the removal of Blinkers could be an added factor for his poor performance. However, he too wasn’t happy with the horse’s performance.

Jockey S. Zervan said that after jump out he pushed the horse but found no response. Also, the horse refused to take gaps and was scared of the horses around him. He said that the horse is immature and needs experience before he starts showing consistency.

Taking into account all the submissions made by the Trainer and the Jockey and after having viewed the race, the Trainer was advised to keep in mind the Calendar Notification “Re : Improvement in performance of horses within a short span of time”, especially since he is a temperamental horse. Further, he was told that the Stipendiary Stewards will be keeping a close watch on the future running of  the horse.

RE : ENQUIRY INTO THE RUNNING AND RIDING OF “ESSENCE OF LOVE” IN RACE NO.34 – THE STAR COMRADE PLATE RUN ON 2ND AUGUST, 2015 :

The Stipendiary Stewards reported that they had questioned Tr.H.J.Antia and Jockey C.Umesh in the above connection. Trainer H.J.Antia said that he had instructed the Jockey to try and get an early position and if not, then to make his way through the field. It was brought to the attention of the Trainer and Jockey’ that no effort was made to gain a position after jump out and the jockey chose to stay wide at the bend and coming into the straight he went in. To this, Jockey U.Mesh stated that he was blocked at the start and subsequently could not find place to improve his position. Also, while coming into the straight the horse on his inside started shifting out, therefore, to avoid being carried outwards, he held back and went for the rails.

The video of the race was viewed and it was pointed out to the Jockey that he made no earnest effort to improve his position. In fact, the horse racing on his inside, “MONZA” who was alongside him at the bend, was ridden out and finished 3rd. The video of the horse’s previous run during the Mumbai Meeting 2014/15 was viewed and it was pointed out how well the horse covered ground when ridden out.

After hearing the submissions made by the Trainer and Jockey and having viewed the video of the race, the Stipendiary Stewards were not convinced with Jockey C. Umesh’s handling of his mount, especially considering his caliber and decided to fine him a sum of Rs.5,000/-.

RE: APPEAL FROM TRAINER B.PRAKASH IN RESPECT OF THE FINE OF RS.50,000/- IMPOSED ON HIM BY THE STEWARDS - ENQUIRY INTO NEGLIGENCE IN HIS YARD :

The Board of Appeal at its meeting held on 13th August 2015 considered Appeal dated 6th August 2015 from Tr.B.Prakash. The Board studied all documents and papers that were submitted and heard the submissions made by Tr.B.Prakash. The Board deliberated the matter and applied their minds to the entire facts of the case. The Board noted that Tr.B.Prakash had admitted that the Electrical fittings in the stables were carried out by a private Electrician and he was aware of the Notice in the Racing Calendar of the Club. This incident was far more serious as it had led to loss of an equine life due to negligence. The Board further observed that a Trainer must be able to pre-empt the safety of his horses as the safety of the equine is of paramount importance.  Therefore, the Board of Appeal decided to reject his Appeal and forfeit his Deposit.
