RACE NO.1 – THE  ATOMIC PRINCE  PLATE: (About) 1400 Metres – 7 Runners

 

Soon after the start, CUMBRE VIEJA (S.Sameer) tried to drift outwards losing ground and thereafter trailed the field. The Sr.V.O. was requested to examine the filly and he reported that no abnormality was detected. Trainer Narendra Lagad has been asked to take remedial measures before next accepting to race the filly.

 

Soon on entering the straight, DELIGHTFUL LADY (App.Yash Narredu) leaned inwards. Trainer M.Narredu has been asked to take remedial measures before next accepting to race the filly.

 

Jockey I.Pasha (DREAM YUGA) reported that he lost his right stirrup iron at the start which he regained shortly.

 

After the race, DREAM YUGA was found to be sound.

 

RACE NO.2 – THE CACOPHONY PLATE (DIV.II): (About) 1000 Metres – 10 Runners

 

Trainer S.Mangalorkar has been fined Rs.1,000/- for accepting with his charge BETHLEHEM whilst the mare was on a Veterinary ban. The mare was struck out at the Acceptance stage.

 

At the start, NEGREDO (App.K.N.Bhati) jumped out awkwardly.

 

Passing 400 metres, TITLEIST (Darren Williams) was held up for a run while racing between FAJR (Akash Agarwal) and MOUNTAIN TREASURE (Vikram Jodha) who leaned inwards thereby reducing the gap for TITLEIST. Shortly afterwards, MOUNTAIN TREASURE  again leaned inwards whereby TITLEIST (Darren Williams) was eased off the heels of MOUNTAIN TREASURE (Vikram Jodha) and had to be shifted out to make its bid.

 

Jockey I.Pasha (ZOE) reported that his mount was inclined to lug-in in the straight. Trainer Altaf Hussain has been asked to take remedial measures before next accepting to race the mare.

 

Jockey C.S.Jodha (HIGHWAY EXPRESS) reported that he lost his whip near 200 metres.

 

After the race, WIND CHIME was found to be sore by the left fore leg. Also, the mare had a cut injury at the left flank. WIND CHIME has to be passed fit by the Club’s VO before next accepting to race.

 

After the race, DREAMLAND was observed to have a cut injury at the left hind bulb of heel. ZOE and MOUNTAIN TREASURE were found to be sound.

 

RACE NO.3 – THE  CACOPHONY PLATE (DIV.I): (About) 1000 Metres – 10 Runners

 

SPEED UP (App.S.Joseph, dr.1) jumped awkwardly outwards and made contact with STARRY OCEAN (Hanumant Singh, dr.2).

At the start, YARDSTICK (S.P.Ranjane, dr.5) jumped awkwardly and shifted in on to WINDSOR QUEEN (App.Yash Narredu, dr.4). Thereafter, WINDSOR QUEEN (App.Yash Narredu) and YARDSTICK (S.P.Ranjane) made contact with each other on a few occasions. After questioning, both the Jockeys have been cautioned to be more careful.

 

SPEED BABY (C.Umesh) was inclined to lean inwards and in the final stages of the race was eased off the heels of WINDSOR QUEEN (App.Yash Narredu). Tr.H.J.Antia has been asked to take remedial measures before next accepting to race the mare.

After the race, WINDSOR QUEEN  and STARRY OCEAN were found to be sound.

 

RACE NO.4 – THE DOUBLE BULL PLATE (DIV.I): (About) 1000 Metres – 10 Runners

 

Approaching 200 metres, ICE SKATES (C.Umesh) lugged in, due to which GREEK GOD (App.Yash Narredu), who was following, shifted out to make his run and in process clipped the heels of ICE SKATES and  stumbled, dislodging its rider. Due to this incident, WASABI (S.Zervan) and ICE AFFAIR (Hanumant Singh) were hampered for a run as the respective riders tried to evade GREEK GOD. Again in the final stages of the race, DIVINE SOLITAIRE (T.S.Jodha) was steadied and eased up as GREEK GOD ran loose. Since the fall was accidental, no action has been initiated in the matter.

 

After the race, ICE SKATES was observed to have a cut injury at the right hock. GREEK GOD was found to be sound.

 

RACE NO.5 – THE DOUBLE BULL PLATE (DIV.II): (About) 1000 Metres – 9 Runners

 

At the start, SILSILA (App.D.S.Daman, dr.2) jumped awkwardly inwards and went on to MOUNTAIN SONG (Hanumant Singh, dr.1) who had also jumped out awkwardly.

 

Soon after the start, SILSILA (App.D.S.Daman) shifted-in and caused interference to MOUNTAIN QUEEN (C.Umesh). App.D.S.Daman has been reprimanded.

 

SILSILA (App.D.S.Daman) did not get a clear run and was ridden hesitantly between 400 and 200 metres due to lack of room while racing on the inside of WIND CRAFT (Akash Agarwal).

 

After the race, DREAMLINER, MOUNTAIN SONG and MOUNTAIN QUEEN were found to be sound.

 

RACE NO.6 – THE FAIR HAVEN TROPHY: (About) 1400 Metres – 11 Runners

 

At the start, DANCING PRANCES (Prabhu Naidu, dr.7) jumped awkwardly outwards and went on to ZORAAVAR (S.Zervan, dr.8), who in turn went across STAR OF GIBRALTAR (J.E.Pereira, dr.8).

 

Jockey D.K.Ashish (FALCON) reported that his mount lugged-in in the straight and in the final stages of the race the gelding shifted-in and made contact with ZORAAVAR (S.Zervan). Trainer M.Narredu has been asked to take remedial measures before next accepting to race the gelding.

 

Jockey Hanumant Singh (ONE WISH) reported the loss of his whip near 250 metres.

After the race, MYLA ROSE was observed to have a cut injury at the left hind pastern and STAR OF GIBRALTOR had a cut injury at the right hind fetlock.

 

RACE NO.7 – THE CAPRICORN TROPHY (DIV.II): (About) 1000 Metres – 11 Runners

 

As a result of the fall sustained by App.Yash Narredu in Race No 4, the connections of ZADORA requested for Jockey D.K.Ashish as a substitute Rider. Since the change of Jockey was not of equal calibre, a Stewards’ meeting was convened. Subsequently, Jockey D.K.Ashish was permitted to ride ZADORA since No Allowance could be claimed in this race.

GYAHANA (Zameer Sayyed) was restless in the stall and not allowing the rider to settle. Trainer D.J.Surti has been asked to give the filly more gate practice and show her to the satisfaction of the Starter at morning starting trials, before next accepting to race.

 

At the start, ACT OF VALOUR (P.Trevor, dr.10) jumped awkwardly outwards, due to which SECRET MISSION (J.Chinoy, dr.11) was forced to travel wide.

 

At the start, MALZIE (T.S.Jodha, dr.1) jumped awkwardly. FULL MOON (S.Zervan, dr.7) jumped awkwardly inwards and went on to ZADORA (D.K.Ashish, dr.6), who in turn went on to SOMETHING SPECIAL (Kavraj Singh, dr.5). BLUE FLAME (C.Umesh, dr.4) jumped awkwardly inwards and made contact with GYAHANA (Zameer Sayyed, dr.3). Shortly afterwards, QUICK ANGEL (I.Pasha) leaned outwards and went on to GYAHANA (Zameer Sayyed) who in turn went on to BLUE FLAME (C.Umesh). 

 

Near 500 metres, MALZIE (T.S.Jodha) was tightened as SOMETHNG SPECIAL (Kavraj Singh) shifted in when pressurized by ZADORA (D.K.Ashish) on its outside. Jockey D.K.Ashish has been cautioned.

 

Jockey C.Umesh (BLUE FLAME) reported that his mount lugged-in in the straight. Trainer H.J. Antia has been asked to take remedial measures before next accepting to race the filly.

 

After the race, GYAHANA was found to be sound.

 

RACE NO.8 – THE CAPRICORN TROPHY (DIV.I): (About) 1000 Metres – 12 Runners

 

IN TIME (P.Trevor) was restless in the stall and not allowing the rider  to settle. LOVEABLE LOCKS  (C.S.Jodha) was reluctant to be stalled. Trainers S.K.Sunderji and H.J.Antia have been asked to give their respective charge more gate practice and show them to the satisfaction of the Starter at morning starting trials, before next accepting to race.

 

Trainer Faisal A.Abbas has been fined Rs 1,000/- for failing to produce the registered racing colours in respect of his charge SECRET OATH (J.Pradeep). The Jockey wore the Emergency colours i.e. All Black.

 

At the start, ARTISTE (Dashrath Singh, dr.2) and JEWEL (Kishore Kadam, dr.6) jumped awkwardly outward and inward respectively, due to which CLOUDS OF GLORY (Prabhu Naidu, dr.3), LEOTHEFIERCEHORSE (Neeraj Rawal, dr.4) and  DIVINE Wish (Towfeeq R.Shaikh, dr.5) were tightened.

 

At the start, QUIZICAL (D.K.Ashish, dr.11) drifted outwards and went across SECRET OATH (J.Pradeep, dr.12) who itself was inclined to drift outwards. Trainers M.Narredu and Faisal A Abbas have been asked to take remedial measures before next accepting to race their respective charge.     

 

RACE NO.9 – THE FINE ARROW PLATE: (About) 1600 Metres – 12 Runners

 

At the request of Trainer Dallas Todywalla, FORGOTTEN VOICE was examined at 0830 hours on 24th July 2014 and was found to be sore by the right fore leg. As such, the filly was certified unfit to race and was withdrawn on Veterinary grounds. The filly has to be passed fit by the Club’s VO before next accepting to race. 

 

PAPPILLON (S.Zervan) lost 2 lengths at the start and   SPLENDID LIGHT (J.Chinoy) took a fly jump.

 

At the start, STORMY PRINCESS (App.K.N.Bhati) jumped out awkwardly.

 

After the race, PAPPILLON and STALWART (examined on 25/07/2014), were found to be sound.

The post race urine sample of the winners of the 4th, 5th, 6th and 9th race viz. RAJSAMMAN, HIDDEN ASSET, FALCON and RICOCHET, and the special sample of DREAMLINER (5th race), were collected for detection of prohibited substance.

ADDITIONAL REPORT/S:

 

RE: ENQUIRY INTO THE COMPARATIVE PERFORMANCE OF “SHOCKALOT” IN RACE NO 317 (PLACED SECOND) RUN ON 6TH APRIL 2014 AS COMPARED TO ITS PREVIOUS STARTS IN RACE NO 255 RUN ON 9TH MARCH 2014 & RACE NO 228 RUN ON 23RD FEBRUARY 2014 – TRAINER FAISAL A.ABBAS

 

The Stipendiary Stewards reported that they had questioned Trainer Faisal A.Abbas in the above connection. The Trainer stated the gelding has been a lethargic starter and would jump out awkwardly and would not raise immediate gallop and that he has been on the Starter’s Ban previously. The gelding was blind folded till end which has helped him and he began to take decent starts.  He added that SHOCKALOT is a mediocre horse and would be able to win in a weak set and he has not performed consistently, except a fourth in Race No.196 and a poor third in Race No 82, the gelding has not shown any form. He added that in Race No.196 with Jockey F Irani up, the gelding was slow but ran on well to finish 4th and he thought the Jockey had ridden him well and therefore he had declared Jockey F Irani in the subsequent races.  He said that he had declared Jockey C.S.Jodha in Race no 317 to see if the gelding will perform any better. He added that the gelding was available at longer odds and the owners are not gambling Owners.

The explanation tendered by the Trainer was noted.

RE: ENQUIRY IN TO THE COMPARATIVE PERFORMANCE OF “QUANDO QUANDO” IN RACE NO 317 (WINNER) RUN ON 6TH APRIL 2014 AS COMPARED TO ITS PREVIOUS STARTS IN RACE NO 277 RUN ON 20TH MARCH 2014 & RACE NO 239 RUN ON 6TH MARCH 2014 – TRAINER DJ SURTI

 

The Stipendiary Stewards reported that they had questioned Trainer D.J.Surti was questioned in the above connection. Tr.Surti gave the veterinary status of the mare and stated that the mare ran in Pune 2013 on 18th October 2013 carrying 62 kg and finished 4th after which she was treated with painkillers. On 19th October 2013, she was x-rayed and painkillers were given. On 27th November 2013 she was given intra-splint injections in both the fore legs but did not get much relief and was finally operated on 16th December 2013 and she was rested after that till 5th January 2014. Thereafter on 16th February 2014 she was entered for a race which went void and she finally got to race on 6th March 2014 where she finished 10th. She again ran on 20th March 2014 and had finished 1 ¼ length behind ICE RINK who had finished 4th in Race no 277 and ICE RINK went on to win later. The mare suffered colic on 26th March 2014. She was given pick-ups till 3rd April 2014 and she ran on 6th April 2014 in Race No 317 and won beating mediocre field in which there were 2 winners only including his charge QUOANO QUANDO and the majority of the field had not even placed in any of their runs.

 

The Trainer further added that vis-à-vis the common horse STAR BENEVOLENT, QUANDO QUANDO was better placed since he had claimed 3 ½ kg allowance this time as compared to the last run and therefore the result is justified also considering that the mare had not run badly in the previous start. He had given the mare a chance to do well but she was not a certainty. The Trainer was informed that he has contravened the Calendar Notification Comparative performance of horses winning in short span of time.

Jockey Zameer Sayyed who rode the mare on the previous occasions when questioned stated that his Instructions have been to be in front bunch and do his best. He stated that in all her runs the mare has been showing improvement and that she has soundness issues. He added that the mare appeared to be ‘heavy’ in her previous runs which may be due to the rest.

 

Jockey S Mosin in Race No 317 was instructed to ‘sit and ride her out from the outside’. When Jockey Zameer Sayyed was questioned with regard to the Instructions he stated that in Race no 277, the mare was well placed and since he had room along the rails in the straight, therefore he did not feel the need to ride out the mare from the outside.  

The matter was reported to the Stewards.

 

The Stewards of the Club at their meeting held on, 30th April, 2014 interviewed Trainer D.J.Surti in the above connection and having heard him, the Stewards were not entirely satisfied with the explanation tendered by him. The Stewards noted that there was a set pattern wherein if he fancied a horse he declares a better calibre Jockey and there is betting on the horse and he was warned to be more careful in the future.

RE:: POSITIVE FINDING IN RESPECT OF ch m “MATRIOSHKA” (PLACED 3RD) IN RACE NO 359 – THE RACING OFFICIALS TROPHY (DIV – II) RUN ON 26TH APRIL 2014 – IN CHARGE OF TR.S.SHAIKH:

 

The Stewards of the Club at their meeting held on 12th June 2014 interviewed Trainer S Shaikh regarding the Positive Report dated 27th May 2014 from LGC, Newmarket, UK, in respect of the urine sample taken from his charge MATRIOSHKA (Placed 3rd) in Race No 359 – The Racing Officials Trophy run on 26th April 2014, which read as under:

 

“THE CONFIRMATORY ANALYSIS WAS PERFORMED USING DOCUMENTED LGC METHODS, WHICH IDENTIFIED THE PRESENCE OF 16B-HIDROXYSTANOZOLOL, A METABOLITE OF STANOZOLOL, IN THE URINE SAMPLE”.

 

At this meeting, Tr.S.Shaikh was handed over a copy of the above report. At this time, Tr.S.Shaikh confirmed that he did not wish to send the “B” Sample of his charge MATRIOSHKA for Confirmatory Analysis and therefore the Stewards treated the positive finding of the Primary Sample of his charge as final and conclusive.  Under the Rules, the Stewards decided to disqualify MATRIOSHKA and revise the Order of Placing as under:

 

                DANCING SPLENDOUR  -               First;                      DOUBLE OR QUITS          -               Third;

                SNOW ANGEL                    -               Second;                                 SEVEN SEAS                       -               Fourth.

 

Further, as per the Clause of the Medication Rules, MATRIOSHKA has been banned from Racing for a period of 6 months i.e. till 12th December 2014.

 

Tr.S.Shaikh was asked to conduct his own enquiries and to lead evidence, if any, to prove mitigating circumstances, within 15 days and to also attend the enquiry to be held by the Stipendiary Stewards and Sr. Veterinary Officer of the Club as and when required to.

 

The Stewards of the Club at their meeting held on Thursday, 24th July, 2014 considered the evidence obtained by the Stipendiary Stewards/Sr.V.O. in the above enquiry and interviewed Mr.S.Shaikh.

 

The Stewards after having thoroughly enquired into the matter and having applied their minds to the entire facts and circumstances of the case and to all papers, proceedings, reports and records and submissions made in the matter and also having permitted Mr.S.Shaikh to make submissions in the subject matter, found that he had no mitigating circumstances to offer in the subject case and as such, held him guilty of breach of the Medication Rules.

 

Further,  the circumstantial evidence in the enquiry leads the Stewards  to believe that :-

 

1)   Mr.S.Shaikh was unable to give a reasonably satisfactory explanation as to how the drug 16B-hydroxystanozolol, a metabolite of stanozolol was found in the urine sample of MATRIOSHKA. However, the fact remained that the mare was administered STANOZOLOL.  Also, STANOZOLOL, an anabolic steroid, is a banned substance for racing horses as per the notification received from the Government of India and its presence in the urine sample of MATRIOSHKA is also a  breach of the Medication Rules and therefore more serious than the mere finding of a prohibited substance;

 

2)            By Mr.S.Shaikh’s own admission, the security in his stable was good and one of his staff was always present in the stable to keep security of the horses and it was not possible for an outsider to enter his stable and administer Stanazolol to MATRIOSHKA. Also, Mr.S.Shaikh stated that he has full faith in his staff and he was confident that they were not involved in administering STANOZOLOL to MATRIOSHKA.

 

3)            Mr.S.Shaikh stated that MATRIOSHKA came to his charge about three weeks before the race. However, he had the choice of having the mare tested before racing her, which he failed to do.

 

4)            Mr.S.Shaikh declared a good calibre Jockey on MATRIOSHKA in the race in question and she was backed down from 12/1 to 5/1. Further, the mare looked in good condition before the race in the paddock and she was fractious in the paddock as well as while going towards the start. Also, she raced very keen during the race and finished a good third.

 

Taking an overall view  and in view of the circumstantial evidence as stated above,   the Stewards held Mr.S.Shaikh guilty of administering the prohibited substance Stanozolol to MATRIOSHKA.

 

The Stewards noted that the positive report in respect of MATRIOSHKA was Mr.S.Shaikh’s second infringement of the Medication Rules pertaining to anabolic steroids and sex hormones, the earlier one being that of URBAN WARRIOR on 21st August, 2010 who was found positive for Boldenone. Also, in the enquiry into the positive finding of URBAN WARRIOR the Stewards had suspended Tr.Shaikh’s license for a period of one year and imposed on him a suspended sentence of one year i.e. if he was again found guilty of breach of the Medication Rules within the next three years after he started training again, then the aforesaid suspended sentence of punishment of one year would ipso facto come into force and effect.

 

The Stewards noted that vide letter dated 6th June, 2014 Mr.S.Shaikh had already surrendered his Trainer’s license.

 

Taking an overall view and keeping in mind that 16B-HYDROXYSTANOZOLOL is an Anabolic Steroid, which is banned by the Government of India and this being Mr.S.Shaikh’s second infringement of the Medication Rules in respect of anabolic steroids and sex hormones, the Stewards of the Club decided :-

 

a)       For the positive report in respect of MATRIOSHKA, to exclude Mr.S.Shaikh for a period of three years i.e. w.e.f. 25th July, 2014 to 24th July, 2017;

b)       As intimated to Mr.S.Shaikh in  the previous order in respect of URBAN WARRIOR enquiry, the suspended sentence of one year ipso facto comes into effect i.e. he was further excluded for a period of one year i.e. from 25th July, 2017 to 24th July, 2018. 

 

Therefore, Mr.S.Shaikh stands excluded for a total of four years i.e. from 25th July, 2014 to 24th July, 2018 from the premises of the racecourse, Mumbai/Pune and all other places wherever the Rules of Racing of this Club are in force.

 

 Further, all the disabilities under the Rules of Racing for Warned Off /Excluded/Disqualified Person, shall be      applicable to him.

 

Also, since he has been excluded,  the permission granted to him to own and race horses under the  Rules of this Club stands revoked. 

 

c)       After Mr.S.Shaikh exhausts his punishment, should he decide to re-apply for a Trainer’s license in the future, the same shall not be granted to him.

RE : APPEAL FROM TRAINER P.SHROFF IN RESPECT OF THE DECISION OF THE STEWARDS OF THE CLUB – RE : ENQUIRY INTO THE POSITIVE REPORT OF THE COMPULSORY SAMPLE OF URINE TAKEN FROM  dk b f “BULLSEYE” ON 6TH DECEMBER,  2013 FOR THE PRESENCE OF ANABOLIC STEROIDS AND SEX HORMONES SINCE THE FILLY HAD RETURNED TO HIM FROM THE STUD FARM :

 

The Board of Appeal at its meeting held on 19th May, 2014 interviewed Tr.P.Shroff in the above connection. The Board of Appeal having heard Tr.P.Shroff and in view of his request to allow certain persons who were not interviewed by the Stewards of the Club, as his witnesses before the Board of Appeal and in view of the fact that the Report dated 12th May, 2014 from the AWBI Enquiry Committee on BULLSEYE was received after the Stewards of the Club had given a decision in the BULLSEYE case, the Board of Appeal considered it to be fresh evidence and therefore, under Rule 47 (b) of the Rules of Racing, decided to refer the matter back to the Stewards of the Club and to stay the order of the Stewards of the Club in the matter until the Stewards of the Club hear the matter. His deposit was ordered to be refunded.

RE : APPEAL FROM M/S NANOLI STUD & AGRICULTURAL FARMS IN RESPECT OF THE DECISION OF THE STEWARDS OF THE CLUB I.E. NOT TO ALLOW TO AND FRO MOVEMENT OF ALL RACING HORSES BETWEEN RWITC LTD. AND M/S NANOLI STUD AND AGRICULTURAL FARMS FOR A PERIOD OF TWO YEARS I.E. UPTO AND INCLUSIVE OF 4TH APRIL, 2016 -  RE : ENQUIRY INTO THE POSITIVE REPORT OF THE COMPULSORY SAMPLE OF URINE TAKEN FROM  dk b f “BULLSEYE” ON 6TH DECEMBER,  2013 AS THE FILLY HAD RETURNED TO TRAINER P.SHROFF FROM THE STUD FARM :

 

The Board of Appeal at its meeting held on 19th May, 2014 interviewed Mr.K.N.Dhunjibhoy in the above connection. The Board of Appeal having heard Mr.K.N.Dhunjibhoy and in view of the fact that he had referred to the expert opinion of Dr.David Crone which is reflected in the Report dated 12th May, 2014 from the AWBI Enquiry Committee on BULLSEYE which report was received after the Stewards of the Club had given a decision in the BULLSEYE case, the Board of Appeal considered it to be fresh evidence and therefore, under Rule 47 (b) of the Rules of Racing, decided to refer the matter back to the Stewards of the Club and to stay the order of the Stewards of the Club in the matter until the Stewards of the Club hear the matter. His deposit was ordered to be refunded.
