Therefore, the Stewards decided to withdraw his Jockey’s license w.e.f. 21st September 2008 to 30th April 2009 (both days inclusive) and further not to grant him a Jockey’s license if he applied for one for the Racing Season 2009/2010 till 1st August 2009. The Stewards of the Club at their Meeting held on 6th September 2008 interviewed Jockey Hanumant Singh and not being satisfied with the explanation tendered by him, decided to suspend his Jockey’s License w.e.f. 21st September to 27th September 2008 (both days inclusive) for careless riding on his mount PINE CREST in the above race. (Permitted to ride work/ Mock race).

RE : ENQUIRY INTO THE POSITIVE REPORT IN RESPECT OF  b f   “YANA” (WINNER) IN RACE NO.144 – THE HDIL INDIAN OAKS (GR.I)  RUN ON 20TH JANUARY, 2008 :

The Stewards of the Club at their meeting held on Tuesday, 2nd September, 2008 considered the evidence obtained by the Stipendiary Stewards/Sr.V.O. in the above enquiry. The Stewards noted that the delay in taking up the case happened due to efforts to obtain information from HHL as required by Trainer Bezan Chenoy.

The Stewards interviewed Trainer Bezan Chenoy and his Spokesman, Dr.Thomas Tobin.

The Stewards gave Trainer Bezan Chenoy and his Spokesman a patient hearing, heard all the submission made on his behalf and also permitted him to bring in witnesses. Opportunity was given to Tr.Chenoy for cross examining Dr.Jeya Prakash. The Stewards after having thoroughly enquired into the matter and having applied their minds to the entire facts and circumstances of the case and to all papers, proceedings, reports and records and submissions made in the matter including all the papers submitted by Tr.Chenoy/his Spokesman at the time of the hearing and having deliberated the matter at length, came to the conclusion that Tr.Bezan Chenoy had no mitigating circumstances to offer in the subject case and as such held him guilty of breach of the Medication Rules, consequently he became vicariously liable.

The Stewards also noted that this was Tr.Bezan Chenoy’s seventh offence of a breach of the Medication Rules. However, as per the changed rules, the offence in case of ANGELINA BALLERINA was not considered as it was a Class V drug.  Since the drug was logged, the Stewards showed some leniency and decided to suspend Tr.Bezan Chenoy’s license for a period of only 61 days instead of a higher suspension as applicable for a sixth infringement. His Trainer’s license stands suspended w.e.f. 17th September, 2008 to 26th October, 2008 (both days inclusive) and from 16th November, 2008 to 6th December, 2008 (both days inclusive) and he was fined a sum of Rs.10,000/- for his vicarious responsibility.

The Stewards also interviewed Dr.P.T.Khambatta along with his Spokesperson and not being satisfied with the explanation tendered by him held him guilty of carelessness in failing to report the treatment given to YANA to the Club’s Sr.V.O. on the race day  as per the procedure. However, keeping in mind that the medication was logged by him as also by Trainer Bezan Chenoy, the Stewards held the view that there was no malafide intent on his part and therefore took a lenient view in the matter and decided to fine him a sum of Rs.5,000/- and to warn him for the future.
