Jockey Neeraj Rawal (ROMANTIC SCENE) was observed to have made his move late in the straight. When questioned, the jockey stated that he was instructed to hit the front and to do his best. It was observed that despite being in the front till top of the straight, he should have made his move when challenged by ROCKEFELLER but he had waited to make his feeble move after he was overtaken by ROCKEFELLER (C. Ruzaan). After having questioned Trainer Dallas Todywalla and not being satisfied with the explanation of Jockey Neeraj Rawal, he has been cautioned for failing to ride out to advantage.

RE: ENQUIRY INTO THE RUNNING AND RIDING OF “QUEENS COURT” IN RACE NO 228 RUN ON 6TH MARCH 2008 - TRAINER NARENDRA LAGAD AND JOCKEY SHAILESH SHINDE

The Stewards at their meeting held on Sunday, 16th March, 2008 interviewed Jockey Shailesh Shinde, along with his Spokesman, Mr. Adil Gandhy, and Trainer Narendra Lagad. They considered all papers and documents and having heard all the submissions  made by Jockey Shailesh Shinde/his Spokesman, including his letter dated 13th March, 2008 in reply to the Show Cause,  and after viewing the video recording of Race No.228,  the Stewards were not satisfied with the explanation tendered by Jockey Shailesh Shinde and held him guilty of not allowing his mount QUEENS COURT to run on its merits in the above race.

The Stewards noted that his Jockey’s license already stands withdrawn up to and inclusive of 31st December, 2008 for an earlier offence on IVANKA.  Therefore, the Stewards decided that for the present offence of not permitting his mount QUEENS COURT to run on its merits, Mr. Shailesh Shinde will not be granted a Jockey’s license, if he applied for the same w.e.f. 1st January, 2009 to 30th April, 2009 (both days inclusive). He was informed that the Stewards had taken extremely lenient view in this case keeping in mind that he was punished earlier on IVANKA.

RE: ENQUIRY INTO THE REPORTED DISCREPENCY IN THE IDENTIFICATION OF “HIGHLAND QUEST” IN RACE NO .235 – THE NADIA MARY HOMI WADIA TROPHY (DIV.I) RUN ON 9TH MARCH, 2008 - TRAINER S.K. SUNDERJI

The Stewards at their meeting held on 16th March, 2008 considered the evidence obtained by the Stipendiary Stewards in the above enquiry and interviewed Trainer S.K. Sunderji as also the Club’s Vets. Having considered all papers and documents and having heard all the submissions  made, the Stewards were not satisfied with the explanation tendered by Tr.S.K.Sunderji and held him guilty of carelessness/ negligence in the discharge of his duties as a Trainer. In that, when he took charge of the above said 2-year-olds (HIGHLAND QUEST & HIGHLAND BOUNTY), he did not bother to identify the said two year olds himself with the Passports, as a result a wrong horse ran in Race No.66 i.e. HIGHLAND QUEST in place of HIGHLAND BOUNTY and subsequently again he brought the wrong horse to race In Race No.235 i.e. HIGHLAND BOUNTY instead of HIGHLAND QUEST.

However, keeping in mind that there was no malpractice involved and also since he had accepted his error and apologized for the same, the Stewards took a lenient view in the matter and decided to fine him a sum of Rs.10,000/- and to severely caution for the future.

The Stewards also held the Club’s V.O. who was on duty on 16th December, 2007 negligent in failing to notice the discrepancy in the markings and allowing the wrong horse to run in Race No.66 and decided to severely reprimand him for his lapse.

Further, since the wrong horse had raced in Race No.66 on 16th December, 2007 the Stewards decided to disqualify HIGHLAND BOUNTY from the said race.

In that, he was aware that TAKE ON was in season but he did not bring the same to the notice of the Club’s Officials before the race. However, subsequently when questioned regarding the poor performance of his charge in Race No.222, he used it as an excuse that the mare performed poorly possibly because she was in season. The Stewards also noted his past record. Therefore, the Stewards decided to fine him a sum of Rs.25,000/-. Further, he was severely warned that on a repetition of a similar offence  severe action will be initiated against him.

RE: RACE NO.242 – THE RADHA SIGTIA TROPHY RUN ON THURSDAY, 13TH MARCH, 2008 - JOCKEY Y.S. SRINATH (NITROUS) REPORTED FOR CARELESS RIDING :

The Stewards at their meeting held on Sunday, 16th March, 2008 interviewed Jockey Y.S. In that, he shifted in before the red marker and tightened FANTASTIC FURY (P.S.Chouhan) along the rails who received severe interference, which could have led to an accident. A Jockey of his caliber was expected to exercise far more control and care whilst riding in a race. However, keeping in mind that Jockey Y.S.Srinath had admitted his mistake, the Stewards took a lenient view and decided to suspend his Jockey’s License w.e.f. 31st March 2008 to 6th April 2008 (both days inclusive) ( permitted to ride work/ Mock race) and to fine him a sum of Rs.20,000/-.

RE: ENQUIRY INTO THE IMPROVED PERFORMANCE OF “PRECISION” IN RACE NO 239 RUN ON 9TH MARCH 2008 WHICH THE MARE WON AS COMPARED TO HER IN THE PREVIOUS STARTS WHERE THE MARE RAN UNPLACED – TRAINER IVOR FERNANDES

Trainer Ivor Fernandes was questioned regarding the improved performance shown by the mare PRECISION in the above race without any past form. The Trainer stated that the mare does not have initial speed and he had instructed the Jockey to be in 6th, 7th position and to do his best and he has been giving the same instructions for each of her starts. He added that in its previous start in Race no 205 the mare has come up as the race has progressed but the Jockey had no room to ride her out due to a wall of horses in front of him. Further, he stated that the PRECISION was favourably placed vis-a-vis the common horse BORN DESTINY in Race no 205 where BORN DESTINY carried 2 kg more than and finished 4 ½ lengths ahead of PRECISION and in Race no 239 the weight difference between the horses was 6 kg and hence PRECISION has finished ahead of BORN DESTINY. Further, BORN DESTINY had an unfavourable Draw as he was drawn 15. He further explained that there was a change of Jockey on PRECISION as Jockey R Shelar, who rode her earlier, could not have made the handicap weight and hence he opted for App.D.K. Ashish and had claimed 1.5 kg allowance. To another question, he stated that he had not fancied the horse at all as there was no form to go by.

After having viewed the previous races of this horse as well as the race in question and considering that there was no betting on this horse, the explanation has been noted.

RE: ENQUIRY INTO THE IMPROVED PERFORMANCE OF “APPRECIATE” IN RACE NO 239 RUN ON 9TH MARCH 2008 AS COMPARED TO HER PREVIOUS START WHERE THE GELDING RAN UNPLACED – TRAINER NARENDRA LAGAD

On questioning, Trainer Narendra Lagad explained that in his previous start in Race No.192, the horse had finished 5 ½ lengths behind the winner. The instructions to the Jockey S.N.Chavan, who rode him in the previous start, was to go to the front. The common horse SEE THE TRUTH has finished behind APPRECIATE on both the occasions. In Race no 192, the horse hit the front and fizzled out in the last furlong. He further added that APPRECIATE has clocked almost the same time in Race no 159 (winner), Race no 192 (unplaced), and Race no 239 (winner), which indicates that the horse has not improved. To another question he stated that he had not fancied the horse and the horse was available at longer odds.

In view of the above, the explanation has been noted.
